GMVT Technologies Private Limited ("the Company", "we", "us", "our", "TMTC" which expressions, unless repugnant to the context thereof, shall include its subsidiaries) is committed to protecting the privacy of the users ("user"/ "you" / "your") of its website https://themedicaltravelcompany.com/ offered by TMTC (collectively, "Site") and has provided this privacy policy ("Privacy Policy", "Policy") to familiarize you with the manner in which TMTC uses, discloses, collects, stores, transfers your personal data and information ("Data") when you use our Site (collectively "Service(s)").

This Privacy Policy is published pursuant to, and in compliance with Zimbabwe's Cyber & Data Protection Act, 2021, and the rules and regulations thereunder.

The terms of the Policy provided herein govern your use of the Site and the information accessible on or from the Site. The Policy also lays down how TMTC may collect, use and share any information you provide. TMTC reserves the right, at its discretion, to change, modify, add or remove portions of this Policy at any time. TMTC recommends that you review this Policy periodically to ensure that you are aware of the current privacy practices.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where "Control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Authority means Postal and Telecommunications Regulatory Authority of Zimbabwe established in terms of section 5 of the Postal and Telecommunications Act.
  • Cookies are small files that are placed on your computer, mobile device or any other device by a website, containing the details of your browsing history on that website among its many uses.
  • Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • Personal Data shall mean information which could reasonably be used to identify you personally, such as your name, email address, physical address, mobile number or other relevant personal details, medical details (including but not limited to, medical history, allergies and other clinical data) and demographic information, such as gender or similar information.
  • Service Provider means any natural or legal person who processes the Data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analysing how the Service is used.

  • the processing relates to Data which has been made public by the user; or
  • the processing is necessary for the purposes of scientific research: Provided the Authority shall be entitled to specify the conditions under which such processing may be carried out; or
  • the processing of Data is authorised by a law or any regulation for any other reason constituting substantial public interest.

Use of your Personal Data

The Company may use Personal Data for the following purposes:

  • To provide and maintain our Service, including to monitor the usage of our Service.

  • For security purposes: If any illegal activity is assumed (technical or payment fraud), then in order to protect the users and the public, and to defend the right or property of TMTC, we may disclose the Data.

Retention of your Personal Data

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this Usage Data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this Usage Data for longer time periods.

  • Right to Rectify: If any of your Personal Data held by us is found to be inaccurate, incomplete, or outdated, you have the right to request corrections or updates. We will take reasonable steps to validate and rectify the information promptly upon receiving such a request.
  • Right to Withdraw Consent: Where we rely on your consent to process your Personal Data or sensitive personal information, you have the right to withdraw that consent at any time. Our Service does not address anyone under the age of 18 (eighteen). We do not knowingly collect personally identifiable information from anyone under the age of 18 (eighteen). We consider it the responsibility of parents to monitor their children's use of our Services. For a minor's safety, we don't allow usage of our Services without parental guidance.

We do not seek or intend to seek to receive any Personal Data from minors. Should a parent or guardian have reason to believe that your child has provided us with Personal Data, please contact us to ensure that the Personal Data is removed. Subject to the provisions in this Policy, the liability of TMTC shall be limited to the removal of Data from the systems and the removal of other personally identifiable elements. Notwithstanding anything to the contrary contained in this Policy and elsewhere, the aggregate liability of TMTC for all claims for damages under the provision of the Services, including claims concerning the violation of this Policy, shall be governed by the provisions under the Terms and Conditions as mentioned on the website of the Company.
